NYAPRS Note: Despite decades of public and legal pressure, NYS continues a shoddy record of failure to keep its promise and legal obligation to help thousands of NYC-based adult home residents with mental health conditions to live in supported housing in the community.
Despite the terms of a 2014 legal settlement, NYS agencies have helped only 475 of 5,000 identified adult home residents with psychiatric disabilities to transition to community based apartments, in keeping with their ADA rights.
Further, state agencies changed course several weeks ago and agreed to suspend implementation of a state regulation aimed at limiting new referrals of adults with psychiatric disabilities to the homes, which were deemed institutions.
In response, Judge Nicholas Garaufis demanded Attorney General Eric Schneiderman to personally appear, an action that was promptly followed by Schneiderman’s withdrawal from the case because his office and the agencies “had a fundamental disagreement about how this matter should be handled.”
Thankfully, this outrage has returned to the pages of the NY Times, which ran a Pulitzer Prize winning series over a decade ago exposing egregious conditions in the homes and the state’s requirement to provide the residents with their legal right to leave these institutions and live in the community. New York Falls Short in Resettling Mentally Ill Adults, Angering Judge

Four years ago, after more than a decade of litigation and negotiation, New York State officials agreed that the system of often dismal and dangerous adult homes was no place for the mentally ill.
They agreed to move as many as 4,000 mentally ill residents out of their apartments and into supportive housing, a hard-fought recognition that people with disabilities should have the opportunity to live independently and participate in all aspects of community life.
But as a July deadline nears, a federal judge has found that the state seems far from meeting its commitment:
Fewer than 500 people have actually been moved into supportive housing from adult homes.
But what the judge, Nicholas G. Garaufis of the Eastern District of New York, found most troubling was that the state appeared to be working with the adult home industry to undermine the settlement.
“I will not allow the kind of political, legal activity that is going on in this case behind my back and behind the backs of the plaintiffs to continue,” Judge Garaufis said at a recent hearing. “If I sound dramatic, it is because it is dramatic. It’s about them. It’s about 4,000 people.”
The Department of Health had quietly reached an agreement with home operators in state court that would have short-circuited the execution of the federal settlement — without ever informing the federal court.
“There’s some sort of a deal,” the judge said. “That’s how it appears. And we’re going to find out exactly what the deal is, because if there is a deal, I would consider it a fraud on the court.”
Adding to the chaos, the state attorney general’s office — the legal representative of the state — said it was unaware of the negotiations between the state and lawyers for the adult home industry “until it was well underway,” and asked last month to withdraw from the federal case, citing irreconcilable differences with its client, the state.
The highly unusual request was denied by Judge Garaufis, whose involvement in the case traces back to its beginnings.
The sprawling network of privately run and state-regulated adult homes in New York City — once considered a promising alternative to the bleak psychiatric wards that the state began closing in the 1960s — began to face increased scrutiny for a host of abuses. A 2002 investigation by The New York Times showed that many had “devolved into places of misery and neglect, just like the psychiatric institutions before them.”
Lawsuits were filed, and after years of court battles, the state reached a settlement that called for residents with mental illness to be moved out of the homes and into supportive housing and be given rental assistance and access to community-based services that promote their inclusion, independence and full participation in community life. The state was given five years to resettle 2,000 to 4,000 residents.
Diana Vila, one of the plaintiffs in the case, is one of the thousands of people who still have not been resettled to supportive housing.
She entered the system more than a decade ago, when a fire forced her from her apartment in Sunnyside, Queens.
She was already in a downward spiral, her depression worsening and her bipolar condition not properly medicated.
Her mother, she said, was a victim of domestic abuse and had to escape to a shelter herself. Ms. Vila had recently lost her job and was growing distant from the rest of her family and friends.
Under the terms of the 2013 settlement, at least 2,000 people with mental health issues were to be moved out of adult homes, like Belle Harbor Manor, and into supportive housing. Unlike the homes, which often feature a combustible mix of people with varying degrees of mental illness, supportive housing apartments are spread throughout the community.
With her apartment destroyed, she found herself in the hospital with no place to go.
So, as with thousands of other New Yorkers in desperate straits, she entered an adult home.
Ms. Vila, 54, was first sent to a home in Queens called Milestone. She described the conditions there as being “like a nightmare.”
There were frequent fights, a staff ill equipped to deal with people with mental illness, and general disarray.
To escape the home, Ms. Vila would get herself hospitalized as often as she could. After a year, she was transferred to Belle Harbor Manor in the Rockaways.
A couple of blocks from the beach, the facility was much cleaner and safer than Milestone, but it was still not home.
She misses her recliner chair, where she would sit with her cats and watch her favorite television programs. She misses cooking skirt steak and ordering takeout Chinese food. She misses hot chocolate heated up in her microwave and an occasional spoonful of ice cream at night. She misses buying cut flowers.
Like many others in the homes, Ms. Vila survives on disability benefits — $1,700 a month, in her case. She pays $1,500 to the adult home, which serves three meals a day. Breakfast is at 8 a.m., lunch is at noon and dinner is at 4:30 p.m.
She is left with $200 a month for everything else. After paying for her phone and cable, she has about $45 a month, which she uses to buy extra food.
Gaining control over her money — and by extension her life — was a big part of the reason she joined the lawsuit against the state.
“There’s so many things that I miss,” she said. “And it’s something that I want again.”
Last month, with the July deadline approaching, Judge Garaufis called all the parties into court for a hearing where, in blunt and caustic language, he warned that the state was “far from hitting its numbers.”
The state rejected the suggestion that it had done anything wrong.
“New York remains unequivocally committed to supporting adult home residents, which is why we are working tirelessly to meet the requirements of the settlement agreement,” the Department of Health wrote in a statement in response to a question.
Even before the hearing, however, advocates for the mentally ill said that the process for resettling residents was deeply flawed.
“The state’s system to help people move out of adult homes is not working,” said Cliff Zucker, the general counsel for Disability Rights New York. “Transition to community living has moved at a snail’s pace, leaving residents confused and frustrated. This is largely because the state has insisted on an inordinately complex process.”
The state officials, however, said that the complex process was necessary in part to ensure that people who moved out of the homes were ready to live more independent lives without endangering themselves or others.
Ms. Vila says she feels safe in her home, but safe is not a life.
“I am not growing,” she said. “I feel like I am standing still.”
Federal Judge Sees New York State Conspiracy to Thwart Care for Mentally Ill
The judge who oversaw landmark case involving troubled homes for the mentally ill sends word to Gov. Andrew Cuomo and Attorney General Eric Schneiderman that state’s efforts to undermine care must end.

A federal judge in Brooklyn has accused state officials of secretly trying to subvert a landmark court order to improve care for thousands of mentally ill residents of New York City.
Three years ago, U.S. District Judge Nicholas Garaufis ended a prolonged lawsuit against New York state by ordering the Department of Health to begin moving as many as 4,000 mentally ill residents housed in group homes to less restrictive environments where they could live more independently. As part of his order, the judge had laid out a timetable for the state to meet its obligations to men and women who had long lived in homes marked by neglect and abuse.
But at a hearing last month, Garaufis angrily charged that officials with the Department of Health appeared to have hatched a plan with the operators of the troubled group homes to get out from under his court order.
“There’s some sort of a deal,” Garaufis said. “That’s how it appears. And we’re going to find out exactly what the deal is, because if there is a deal, I would consider it a fraud on the court.”
A spokesman for the Department of Health said there was no secret plan, and that the state remained committed to meeting its obligations under the court order. A spokesman for the attorney general’s office, which has represented the state in the litigation for more than a decade, denied its lawyers were complicit in any effort to subvert the court order. The attorney general’s office has in recent weeks sought to distance itself from the Department of Health.
The development amounted to a remarkable moment in a case that began 15 years ago with a series of exposés in The New York Times. The articles portrayed a life of misery and exploitation for vulnerable people who had been discharged from state psychiatric hospitals only to wind up effectively warehoused in forprofit homes run by operators little interested in the wellbeing of their residents.
Lawyers for the residents soon filed suit, and what followed were years of hearings, depositions, a lengthy trial, a successful appeal, and eventually the intervention of the
U.S. Department of Justice. Ultimately, Garaufis issued his order, and installed an independent monitor to make sure the state made good on its promises to first assess, and then relocate, residents from some of the biggest and most troubled adult homes in New York City.
Garaufis was alerted to the idea that the state was working to undercut his order in February as the Department of Health prepared to update the court on its progress in relocating residents. Garaufis said the scheme, as he saw it, involved efforts by the adult home industry to have critical regulations at the heart of the 2014 settlement effectively voided. The regulations limited the ability of home operators to accept new mentally ill residents.
In laying out the alleged secret deal, Garaufis said lawyers for the adult home operators had met with officials from the Department of Health, and that they basically worked together to have a state judge issue a temporary restraining order governing the regulations. The action by the state judge, Kimberly A. O’Connor, triggered a provision in Garaufis’ order.
Under the terms of the federal order, any dispute over the regulations that cannot be resolved in 120 days would mean the entire consent decree governing the residents of the homes would be voided. Why the fate of the settlement was being litigated in state court without his knowledge, Garaufis said, was incomprehensible.
Furious, Garaufis held a hearing on March 22, one he required be attended by the state commissioner of health, the commissioner of mental health and the counsel to Gov. Andrew M. Cuomo. He excoriated the group and said he was enraged that the residents of the homes were caught up in politics.
“If I sound dramatic, it is because it is dramatic,” Garaufis said. “It’s about them. It’s about 4,000 people.”
“I will not allow the kind of political, legal activity that is going on in this case behind my back and behind the backs of the plaintiffs to continue,” he said.
ProPublica sent requests for comment to Cuomo’s office, but got no response. A request to speak directly with Attorney General Eric Schneiderman was denied.
At the hearing in March, Garaufis authorized lawyers representing the mentally ill residents to depose an array of state officials and said if a new trial was required, he would conduct it in July, and he would require the state commissioners to attend it. He also said he was intent on exploring possible sanctions against the state.
Lawyers with one of the city’s most prestigious law firms, Paul, Weiss, Rivkind, Wharton and Garrison, have worked on behalf of the mentally ill residents for more than a decade. At the hearing in March, Garaufis allowed a lawyer from the firm to respond to the state’s conduct.
“I don’t even know how to catalogue my outrage,” the lawyer, Andrew Gordon, said. “I mean, whether it’s the court’s efforts, Paul, Weiss’s efforts over the last 10 years, whether it is the fact that it appears that a federal order of this court has been ignored, whether it is the fact that the Department of Health and Office of Mental Health — who are charged with protecting one of the most vulnerable populations — appears to be in cahoots with the adult home industry. I don’t even know where to start.”
The state, according to Garaufis, is behind in meeting its deadlines for assessing residents of the homes and moving those who want to move into more independent housing. By July 2017, the fourth year of the settlement, the state is supposed to have assessed at least 2,500 adult home residents and to have helped move out those appropriate. By December 2016, it had only assessed 1,545 residents and moved 472 residents into supportive housing, according to the judge.
The Department of Health said it, in fact, was on schedule to meet the requirements of the court order. To date, a spokesman said, the state had provided information on the option to move to 4,406 individuals.
In a statement, Gary Holmes, an assistant commissioner at the Department of Health, said:
“New York remains unequivocally committed to supporting adult home residents, which is why we are working tirelessly to meet the requirements of the settlement agreement. At the same time, we are also responsible for ensuring that the individual needs of each resident are met — including their constitutional right to choose where to live. But one of these actions doesn’t come at the expense of the other, and considering the steps we are taking to prioritize the wellbeing of vulnerable New Yorkers, the assertion that this isn’t our goal is misinformed and offensive.”
By Garaufis’ telling, the collusion between the state and the adult home industry began with an unremarkable case in state court in Albany. Jeffrey Sherrin, a lawyer representing the industry, asked an Albany judge to act on behalf of a single adult home resident who had moved from an adult home, but wanted to return.
As part of the 2014 legal settlement, the state had agreed to adopt and enforce regulations aimed at limiting the number of mentally ill people who could be living at the troubled group homes at any given time. The regulations were meant to promote the continuing process of placing residents in apartments more integrated into the city’s neighborhoods.
Those regulations contain two crucial requirements: one, that homes with 80 or more residents — at least a quarter of which have some form of mental illness — not accept more residents with mental illness; two, that psychiatric hospitals not discharge parties to homes where 25 percent of residents are mentally ill.
Sherrin, the lawyer for the adult homes, argued that the man who wanted to return to one of the homes had been prevented from doing so as a result of the regulations.
Sherrin asked the Albany judge to issue an order suspending the regulations. The New York attorney general, representing the state Department of Health and the Office of Mental Health, consented without argument to Sherrin’s request, and the judge granted the order. According to Garaufis, the state officials never informed the Albany judge of his federal order and the long history of abuse and litigation.
The state never notified Garaufis of the Albany case or the order. Now, lawyers for the residents said they have documents showing that the entire proceeding before the Albany judge was basically choreographed. The documents have not been entered into evidence, and lawyers for the plaintiffs declined to show them to ProPublica, but they appear to be communications between Sherrin and state health officials — lunch dates and letters concerning legal strategy.
“Two things are clear, your honor, from these documents,” Gordon told Garaufis at the hearing. “One, they wanted to get rid of the regs and the state was going along with it; and two, they wanted to get rid of you and the state was going along with it.”
At the hearing, state officials sought to assure Garaufis that they never meant the Albany judge’s restraining order to apply beyond the case of the man seeking to return to an adult home.
Strikingly, lawyers with the attorney general’s office have asked Garaufis to allow them to withdraw from the case, citing “a fundamental disagreement about how these matters should be handled” with the other state agencies.
The attorney general’s office declined to comment on this story, instead directing ProPublica to its legal filings.
In a letter to Garaufis, the attorney general’s office cites the state code of professional conduct in asking to withdraw. The letter does not specify the office’s disagreement with the Department of Health, but it asserts that the department has “failed to cooperate” with the office in the recent dealings with the adult home litigation.
Lawyers with the state attorney general’s office have insisted to Garaufis that they did not know about the seeming agreement by the Department of Health to consent to Sherrin’s bid for a restraining order. The office said it was not the first time the Department of Health had “bypassed” it to “communicate directly with opposing counsel.”
In yet another twist, the plaintiff’s attorneys have expressed concern to Garaufis that if the attorney general does withdraw, the state will wind up being represented directly by adult home industry lawyers. In a letter to the judge, the plaintiffs pointed out that state officials showed up to meetings alongside industry lawyers and, strangely, industry lawyers have recently been added as cocounsel in two other cases being defended by the state.
Garaufis assured the court that would not come to pass.
“I doubt that’s ever going to happen in this court. Ever, ever, ever. You’ve got to do better than that,” he said, later, adding: “I am not going to tolerate a situation where the State defendants are represented by an entity that represents parties who have an adverse interest to this settlement.”Telephone calls and emails to Sherrin seeking comment were not responded to.
It is unclear what exactly will happen next.
At Garaufis’ direction, the Department of Health said it would allow the resident to return to the adult home. The attorney general’s office notified the judge in Albany of that development and indicated there was no longer a need for the temporary restraining order concerning the adult home regulations. But Sherrin, the adult homes lawyer, has indicated he will seek to keep the restraining order in effect.
Most importantly, lawyers for the residents and the state are in talks to settle their differences concerning the settlement.
Garaufis, appointed to the federal bench by President Bill Clinton in 2000, has developed a reputation as something of a firebrand. He is perhaps best known for a 2010 ruling in favor of minority firefighters who sued New York City’s Fire Department for discrimination in its hiring practices. He called the practice a “persistent stain” on the department’s record. Last year, he scolded the law firm Kirkland & Ellis for sending a junior associate to defend the social media company Facebook against allegations that it was failing to deter terrorists from using its website for recruiting purposes. “I think it’s outrageous, irresponsible, and insulting,” he said.
At the March hearing, he was similarly pointed in his remarks.
“I am trying to outlive this case, and the State is not making it easy,” he said, adding that he wanted to send a message back to Albany that you can’t “use the courts in such a way that the people who are being protected by this settlement are going to be undermined.”
